Terms of Service

This is an initial policy template and requires final legal review before it should be relied upon as a complete, binding Terms of Service. It does not yet include a registered legal entity name, mailing address, or governing-law jurisdiction, which will be added once finalized by UpperWebs and reviewed by counsel.

1. Acceptance of terms

By using the UpperWebs website at https://upperwebs.com or engaging UpperWebs for services, you agree to these Terms of Service.

2. Services

UpperWebs provides website design, hosting, and maintenance, along with separate services that may include domain registration, business email, SEO, Google Business Profile management, online stores, appointment booking, payments, business phone, business mobile, cloud storage, Cloud PC, and accounting/bookkeeping support. Not all services are available at all times — current availability is noted on each service's page.

3. Website package pricing

Current website packages and pricing are as follows and are subject to change with notice:

  • Starter (1–3 pages): $150 one-time website design/setup, $25/month hosting and maintenance.
  • Business (4–10 pages): $350 one-time website design/setup, $50/month hosting and maintenance.
  • Business Pro (10+ pages): From $500 one-time website design/setup, From $100/month hosting and maintenance.

Website packages do not include unlimited content changes, domain registration, professional email, ongoing SEO, Google Business Profile management, appointment systems, or online store/e-commerce functionality. These are separate services.

4. Domain registration

Domains purchased through UpperWebs are registered through an accredited registrar partner using your provided registrant information. UpperWebs is not itself an ICANN-accredited registrar. Domain availability and pricing shown on our website are checked and calculated at the time of your search and re-verified before registration; domain registration is not completed until payment has been confirmed. If a domain becomes unavailable or registration otherwise fails after payment, UpperWebs will address the matter through a refund or manual review rather than retaining payment for a domain that was not registered.

5. No guaranteed outcomes

UpperWebs does not guarantee specific search engine rankings, guaranteed leads, guaranteed sales, or guaranteed uptime. Service level details, where offered, will be described separately.

6. Payment & billing

One-time setup fees are billed at the time work begins unless otherwise agreed. Monthly hosting and maintenance fees, and fees for any additional services, are billed on a recurring basis for as long as the applicable service continues.

7. Acceptable use

You agree not to use UpperWebs services for unlawful purposes, to host or transmit malicious content, or to infringe the rights of others.

8. Termination

Either party may discontinue services in accordance with the specific service agreement applicable to that service. Discontinuing hosting or a domain may result in loss of access to that website, domain, or email unless arrangements are made in advance.

9. Limitation of liability

To the maximum extent permitted by law, UpperWebs is not liable for indirect, incidental, or consequential damages arising from use of our website or services.

10. Changes to these terms

We may update these Terms of Service from time to time. Material changes will be reflected by an updated "Last updated" date on this page.
